Louisiana’s New Seafood Labeling Law: What Restaurants Need to Know
Dec 3, 2024
Effective January 1, 2025, Louisiana's updated seafood labeling law aims to promote transparency and protect consumers by providing accurate information about the origin of crawfish and shrimp served in food establishments. Replacing previous labeling requirements, the new law emphasizes truth in advertising while supporting Louisiana's renowned seafood industry. Here’s a breakdown of what the law entails and how it affects restaurants.
Key Provisions for Restaurants
1. Menu Labeling for Imported Crawfish or Shrimp
- Restaurants that serve imported crawfish or shrimp and use printed menus must include the following statement on their menus:
"Some items served at this establishment may contain imported crawfish or shrimp. Ask for more information." - The statement must match the font size and style used throughout the menu, ensuring it is clear and consistent.
2. Signage for Establishments Without Printed Menus
- Food establishments that do not use menus are required to display a sign with the same language:
"Some items served at this establishment may contain imported crawfish or shrimp. Ask for more information."
- Sign Requirements:
- Minimum dimensions: 18 inches by 18 inches
- Text in English with letters at least one inch in height
- Positioned in a clearly visible location for patrons.
3. Prohibition of Misleading Labels
- Restaurants cannot falsely advertise or imply that imported seafood is of Louisiana origin. This includes verbal claims, menu descriptions, or visual cues like signage or packaging that may mislead customers.
4. Enforcement and Penalties
- The Louisiana Department of Health will oversee compliance.
- Penalties for violations:
- First offense: Fine between $200 and $500.
- Subsequent offenses: Higher penalties to encourage adherence.
Preparing Your Restaurant for Compliance
To avoid fines and ensure a smooth transition:
- Review Menus: If you serve imported crawfish or shrimp, update your menus with the required statement.
- Install Signs: For non-menu establishments, create and display signs that meet the size and content specifications.
- Train Staff: Educate employees about the law to handle customer inquiries about seafood origins effectively.
- Audit Labels: Double-check that all menu descriptions and advertising materials accurately reflect the origin of your seafood.
